Axis Services, Inc. - Represented 36-unit homeowners association against general contractor for failed repairs of seven-story building in Pacific Heights, San Francisco. Condominium units and windows experienced severe water intrusion, and exterior envelope of building had extensive stucco defects. Case settled after opening statements in March 2016 for $1,500,000.

Cotati Brand Eggs, Inc. v. Cary & Associates Builders, Inc. – Represented commercial food-distribution business in Sonoma County, CA, against general contractor of 22,000 square-foot warehouse. Freezer floor of warehouse experienced severe heaving and cracking caused by defective construction. Case settled prior to trial in March 2015 for $1,065,000.

301 Bryant Street HOA v. Rincon Point Development Co., LLC et al. – Represented 39-unit homeowners association against developer and general contractor of nine-story building in SOMA, San Francisco. Condominium units experienced severe water intrusion, condensation, and window failures; exterior envelope of building had extensive exterior-stucco defects. Case settled prior to trial in November 2014 for $4,500,000.

60 Rausch Street HOA v. 60 Rausch, LLC – Represented 37-unit homeowners association against developer and general contractor of multi-story building in SOMA, San Francisco. Condominium units experienced severe water intrusion and window failures. Case settled prior to trial in January 2014 for $1,000,000.

Sierra Texas HOA v. R Group, Inc. – Represented 67-unit homeowners association against developer and general contractor of multi-level condominium buildings on Potrero Hill in San Francisco. Units experienced severe water intrusion, condensation, and structural defects. Case settled prior to trial in August 2013 for $1,698,750.

929-939 Vermont Street HOA v. Vermont Street Townhomes, LLC et al. – Represented six-unit homeowners association against developer and general contractor in San Francisco. Condominium units experienced severe water intrusion and stucco failures. Case settled at mediation in April 2013 prior to litigation for $75,000.

200 Townsend Street Lofts Owners Association v. 200 Townsend, LLC et al. – Represented 51-unit owners association against developer and general contractor of multi-story building in SOMA, San Francisco. Condominium units experienced severe water intrusion, window failures, and drainage defects. Case settled prior to trial in May 2013 for $1,040,000.

1440 Broadway Condominium Owners’ Association, Inc. v. Ottmann Properties, Ltd. – Represented 28-unit owners association in San Francisco against developer for water intrusion, structural defects, and unfunded monetary reserves. Two settlements were reached with developer in 2009 and 2011, respectively, totaling $395,000.

1026 Church Street HOA v. Stanton Architecture – Represented three-unit homeowners association in San Francisco against architecture for water- intrusion issues.  Claim was settled before litigation in December 2011 for repairs funded by architect.

550 Stanyan Street HOA v. SF Homes et al. – Represented 9-unit homeowners association in San Francisco against developer for water intrusion, window failures, and stucco defects.  Case settled prior to trial in September 2010 for $590,000.

2412 Harrison St. HOA v. Eicon, Inc., GGM LLC et al. – Represented 40-unit homeowners association against developer and general contractor of multi-story building in the Mission District of San Francisco. Condominium units experienced systemic window failures and severe water intrusion. Case settled prior to trial in May 2009 for $1,217,500

Del Mar Terrace Owners Association v. Nevis Homes – Represented owners association in construction-defect case involving condominium conversion project in Pasadena, CA. Settlement reached in March 2010 for $800,000 plus 30% recovery of developer's cross-action against roofer. 

Bennett v. Lupinsky - Breach-of-contract case by single-family homeowner against architect, general contractor, and structural engineer in Contra Costa County. Settlement with general contractor reached in June 2008 for $45,000; settlement with engineer in October 2008 for minor sum plus engineering services. Court trial against architect in February 2009 resulted in final settlement September 2009.

Pacific Pointe v. R.D. Olson Construction Co. – Represented commercial building owner in landslide-subsidence case against general contractor. Partial settlement reached in December 2007 for $722,500. Subsequent indemnity claim against geotechnical engineer Kleinfelder, Inc. settled in November 2008 for $162,500.

The Villages Association (Valle Vista) v. Shea Homes – Represented homeowners association in construction-defect case involving 72 condominium units in in San Jose, CA.  Units experienced a variety of defects including water intrusion, roofing deficiencies, and foundation cracking. Settled in September 2007 for $1,110,000.

Westwood Cove HOA v. Carter Gough Construction, Inc. – Represented homeowners association in construction-defect case involving 102 condominium units in Antioch, CA. Units experienced water intrusion and window failures. Case settled in June 2007 against bankrupt contractor for $300,000.

The Villages Association (Sonata) v. Shea Homes – Represented homeowners association in construction-defect case involving 102 condominium units in in San Jose, CA. Settled on June 6, 2007, for $1,550,000.

The Villages Association (Olivas) v. UDC (Shea Homes) – Represented 207-unit homeowners association in construction-defect case against developer and general contractor in San Jose, CA. Settled on April 26, 2007, for $3,150,000.

Cape Horn Lofts Homowners Association v. Thompson-Brooks, Inc. et al. – Represented 16-unit homeowners association against developer and general contractor of multi-story loft development on Delancy Street in San Francisco. Condominium units experienced systemic window failures, flooring defects, and water intrusion. Case settled in June 2006 for $660,000.
